This protection fits within the broader framework of whistleblower protection already established under European law, extended to violations specific to the EU AI Act: an employee who discovers, for example, that their employer is marketing a high-risk AI system without the required technical documentation, or without having conducted the necessary conformity assessment, can report it through protected channels without suffering negative professional consequences.
For companies, this entails an obligation to set up confidential and accessible internal reporting channels, as well as the need to review personnel management policies to ensure no disciplinary action can be interpreted as retaliation against someone who reported a possible violation in good faith. It is also an indirect incentive to maintain solid compliance practices, knowing that internal violations are more likely to surface.
The principle of whistleblower protection has a broader regulatory history than artificial intelligence, established in Europe through a dedicated directive protecting those who report violations of Union law across various domains, and is now also applied to the specific area of AI system compliance, consistent with the approach adopted for other sectoral regulations.
