Serious incident reporting is the obligation, required of providers of high-risk AI systems and certain general-purpose models, to notify competent authorities of events in which the system caused or risked causing significant harm to people's health, safety or fundamental rights. It is the tool through which the European regulatory framework maintains visibility into how AI systems actually behave after being placed on the market.
The mechanism sets precise timeframes within which the report must be made from the moment the provider becomes aware of the incident, a minimum content for the information to be transmitted (nature of the event, probable causes, corrective measures adopted), and in some cases an obligation to suspend the system's use until the issue has been clarified or resolved. Authorities can use these reports to spot recurring patterns across different providers.
For companies, this obligation requires setting up in advance internal processes for detecting and classifying incidents, fast communication channels between technical teams and legal or compliance teams, and ready-made templates so as not to waste precious time in the most delicate phase, the one immediately following the discovery of a problem.
The principle of mandatory incident reporting is borrowed from more mature regulated sectors, such as pharmaceuticals and aviation, where adverse-event reporting systems have been in use for decades and have proven effective at preventing similar problems from recurring on a large scale.
