Extraterritorialità della regolamentazione AI
Extraterritoriality of AI regulation is the feature whereby a law adopted by a specific jurisdiction, such as the European Union, also applies to entities established outside that territory, when their AI systems produce effects within it. There is no need to have a legal seat within the rule's area of application to be bound by it: it is enough that the system's output is used by, or has effects on, people located there.

In the case of the EU AI Act, this means a company based, for example, in the United States or Asia must comply with the European regulation if it places an AI system on the Union market or if its system's output is used by people within the Union, regardless of where the system was developed or where the technical infrastructure running it resides. This mechanism mirrors the approach already adopted by the GDPR regarding personal data protection.
For global companies, extraterritoriality means it is not possible to opt out of a regulatory framework simply by avoiding a legal seat in that jurisdiction: if the product reaches users in that territory, the obligations still apply, often making it simpler and cheaper to design a single global compliance standard aligned with the most demanding regime, rather than maintaining different product versions for each market.
This phenomenon, often informally called the "Brussels effect", describes the European Union's ability to influence global standards through the extraterritorial reach of its regulations, a pattern already observed with the GDPR and now repeating with the EU AI Act in setting reference practices even for companies operating mainly outside the Union.
L'extraterritorialità della regolamentazione AI è la caratteristica per cui una normativa adottata da una specifica giurisdizione, come l'Unione Europea, si applica anche a soggetti stabiliti al di fuori di quel territorio, quando i loro sistemi AI producono effetti al suo interno. Non è necessario avere una sede legale nell'area di applicazione della norma per esserne vincolati: è sufficiente che l'output del sistema sia utilizzato o abbia effetti sulle persone che vi si trovano.
Nel caso dell'EU AI Act, questo significa che un'azienda con sede, ad esempio, negli Stati Uniti o in Asia deve rispettare il regolamento europeo se immette un sistema AI sul mercato dell'Unione o se l'output del proprio sistema è utilizzato da persone all'interno dell'Unione, indipendentemente da dove il sistema sia stato sviluppato o dove risieda l'infrastruttura tecnica che lo fa funzionare. Questo meccanismo ricalca l'approccio già adottato dal GDPR in materia di protezione dei dati personali.
Per le aziende globali, l'extraterritorialità significa che non è possibile scegliere di ignorare un quadro normativo semplicemente evitando di stabilire una sede legale in quella giurisdizione: se il prodotto raggiunge utenti in quel territorio, gli obblighi si applicano comunque, spesso rendendo più semplice ed economico progettare un unico standard di conformità globale allineato al regime più esigente, piuttosto che mantenere versioni diverse del prodotto per ogni mercato.
Questo fenomeno, spesso definito informalmente "effetto Bruxelles", descrive la capacità dell'Unione Europea di influenzare gli standard globali attraverso l'estensione extraterritoriale delle proprie normative, un pattern già osservato con il GDPR e che si sta ripetendo con l'EU AI Act nel definire pratiche di riferimento anche per aziende che operano prevalentemente fuori dall'Unione.
