The EU AI Act is the European Union regulation governing the development, market placement and use of AI systems within the European economic area. It is the world's first horizontal legal framework specifically dedicated to AI, designed to apply across all sectors, from healthcare to finance, from education to human resources, rather than governing a single application domain.

The regulation adopts a risk-based approach: it classifies AI systems into categories (unacceptable risk, high risk, limited risk, minimal risk) and sets obligations proportionate to the severity of the risk the system may pose to health, safety or fundamental rights. It applies not only to companies based in the EU but to anyone placing AI systems on the European market or whose outputs are used within the Union, with an extraterritorial reach similar to the GDPR's.
For companies and developers, the AI Act brings concrete obligations: mapping their AI systems against the risk categories, preparing technical documentation, ensuring human oversight over high-risk systems, and in some cases undergoing conformity assessments before commercialization. Penalties for the most serious violations are among the highest in the European regulatory landscape.
The regulation was proposed by the European Commission in 2021 and entered into force through a progressive, staggered application, with different obligations taking effect at different times depending on the risk category. It represents the EU's attempt to replicate, in the AI domain, the global regulatory influence already achieved with the GDPR on data protection.

È il primo quadro normativo orizzontale al mondo dedicato specificamente all'AI, pensato per applicarsi trasversalmente a tutti i settori, dalla sanità alla finanza, dall'istruzione alle risorse umane, anziché disciplinare un singolo ambito applicativo.
Il regolamento adotta un approccio basato sul rischio: classifica i sistemi AI in categorie (rischio inaccettabile, alto rischio, rischio limitato, rischio minimo) e stabilisce obblighi proporzionati alla gravità del rischio che il sistema può generare per la salute, la sicurezza o i diritti fondamentali delle persone. Si applica non solo alle aziende con sede nell'UE, ma a chiunque immetta sistemi AI sul mercato europeo o i cui output siano utilizzati nell'Unione, con un impatto extraterritoriale simile a quello del GDPR.
Per aziende e sviluppatori l'AI Act comporta obblighi concreti: mappare i propri sistemi AI secondo le categorie di rischio, predisporre documentazione tecnica, garantire sorveglianza umana sui sistemi ad alto rischio, e in alcuni casi sottoporsi a valutazioni di conformità prima della commercializzazione. Le sanzioni per le violazioni più gravi sono tra le più elevate nel panorama normativo europeo.
Il regolamento è stato proposto dalla Commissione Europea nel 2021 ed è entrato in vigore attraverso un'applicazione progressiva e scaglionata nel tempo, con obblighi diversi che decorrono in momenti successivi a seconda della categoria di rischio. Rappresenta il tentativo dell'UE di replicare, in ambito AI, l'effetto normativo globale già ottenuto con il GDPR sulla protezione dei dati.
