Fornitore e Deployer (AI Act)
Provider and deployer are the two fundamental roles the EU AI Act distinguishes along an AI system's value chain, each with different regulatory obligations. The provider is whoever develops an AI system, or has it developed on their behalf, and places it on the market or puts it into service under their own name or trademark. The deployer, by contrast, is whoever uses an AI system already developed by others, in the course of their professional activity.

The deployer, by contrast, is whoever uses an AI system already developed by others, in the course of their professional activity.
The distinction is crucial because regulatory obligations differ and are proportionate to the role: the provider is mainly responsible for the system's intrinsic compliance (risk management, data quality, technical documentation, conformity assessment), while the deployer is mainly responsible for the correct use of the system in its specific context, including human oversight and use consistent with the instructions provided. In some cases an organization may take on both roles simultaneously, for example when it substantially modifies a system purchased from a third party.
For companies, understanding which role they occupy relative to each AI system used is the first step to correctly identifying which obligations apply: a company integrating a third party's model into its own product might discover it is considered a provider, with obligations far broader than those set for a simple deployer.
This distinction between roles along the value chain mirrors a model already used in European product safety law, which has long distinguished manufacturers, importers, distributors and end users, each with responsibilities proportionate to their role in the supply chain.
Fornitore e deployer sono i due ruoli fondamentali che l'EU AI Act distingue lungo la catena del valore di un sistema AI, ciascuno con obblighi normativi differenti. Il fornitore è chi sviluppa un sistema AI, o lo fa sviluppare per proprio conto, e lo immette sul mercato o lo mette in servizio con il proprio nome o marchio. Il deployer è invece chi utilizza un sistema AI già sviluppato da altri, nell'ambito della propria attività professionale.
La distinzione è cruciale perché gli obblighi normativi sono diversi e proporzionati al ruolo: il fornitore risponde principalmente della conformità intrinseca del sistema (gestione del rischio, qualità dei dati, documentazione tecnica, valutazione di conformità), mentre il deployer risponde soprattutto delle modalità corrette di utilizzo del sistema nel proprio contesto specifico, inclusa la sorveglianza umana e l'uso conforme alle istruzioni fornite. In alcuni casi un'organizzazione può assumere entrambi i ruoli contemporaneamente, ad esempio quando modifica sostanzialmente un sistema acquistato da terzi.
Per le aziende, capire in quale ruolo si trovano rispetto a ciascun sistema AI utilizzato è il primo passo per individuare correttamente gli obblighi da rispettare: un'azienda che integra un modello di terzi in un proprio prodotto potrebbe scoprire di essere considerata fornitore, con obblighi ben più estesi di quelli previsti per un semplice deployer.
Questa distinzione tra ruoli lungo la catena del valore ricalca un modello già utilizzato nella normativa europea sulla sicurezza dei prodotti, dove da tempo si distinguono produttori, importatori, distributori e utilizzatori finali, ciascuno con responsabilità proporzionate al proprio ruolo nella catena di fornitura.
