Standard tecnici armonizzati per l'AI
Harmonized technical standards for AI are detailed technical specifications, developed by European standardization bodies, that translate the general obligations set by the EU AI Act, such as risk management, data quality or system robustness, into concrete, measurable technical requirements. They are not laws in the strict sense, but compliance with them creates a presumption of conformity with the regulation, greatly simplifying the task of demonstrating compliance.

The mechanism works as follows: the regulation defines goals and requirements at a relatively high level of abstraction, while the harmonized technical standards specify how to concretely achieve those goals, for example by indicating precise methodologies for testing a model's accuracy or documenting training data. A provider following these standards can presume compliance, while those choosing alternative approaches must independently demonstrate they achieve the same level of protection.
For companies, relying on these technical standards reduces the interpretive uncertainty inherent in a general regulatory text, providing a clearer operational path to follow, especially for technical teams who must translate legal requirements into concrete design and testing choices.
This mechanism of deferring from law to technical standards, known as the "New Approach", has been used in Europe since the 1980s for industrial product regulation, and has been extended to artificial intelligence precisely to enable regulation capable of adapting quickly to technological progress without having to continually amend the law itself.
Gli standard tecnici armonizzati per l'AI sono specifiche tecniche dettagliate, sviluppate da organismi europei di normazione, che traducono in requisiti tecnici concreti e misurabili gli obblighi generali stabiliti dall'EU AI Act, come la gestione del rischio, la qualità dei dati o la robustezza dei sistemi. Non sono leggi in senso stretto, ma il loro rispetto crea una presunzione di conformità al regolamento, semplificando notevolmente il lavoro di chi deve dimostrare di essere in regola.
Il meccanismo funziona così: il regolamento definisce obiettivi e requisiti a un livello di astrazione relativamente alto, mentre gli standard tecnici armonizzati specificano come raggiungere concretamente quegli obiettivi, ad esempio indicando metodologie precise per testare l'accuratezza di un modello o per documentare i dati di addestramento. Un fornitore che segue questi standard può presumere di essere conforme, mentre chi sceglie approcci alternativi deve dimostrare autonomamente di raggiungere lo stesso livello di protezione.
Per le aziende, affidarsi a questi standard tecnici riduce l'incertezza interpretativa insita in un testo normativo generale, fornendo un percorso operativo più chiaro da seguire, soprattutto per i team tecnici che devono tradurre requisiti legali in scelte di progettazione e test concreti.
Questo meccanismo di rinvio dalla legge agli standard tecnici, detto "nuovo approccio", è utilizzato in Europa dagli anni '80 per la regolamentazione dei prodotti industriali, ed è stato esteso all'intelligenza artificiale proprio per permettere una regolamentazione capace di adattarsi rapidamente ai progressi tecnologici senza dover modificare continuamente la legge stessa.
