Sandbox regolamentare
A regulatory sandbox is a controlled environment, established by public authorities, in which companies and developers can test innovative AI systems under the regulator's direct supervision, before or during their market placement, benefiting from direct dialogue with authorities on how to correctly interpret applicable regulatory obligations.

The typical setup involves a company being admitted to a program lasting several months, during which it trials its AI system under real but confined conditions, with the competent authority providing practical guidance on compliance, risk assessment and required documentation. At the end of the program, the company has greater clarity on how to fully comply before launching at scale.
For companies, particularly startups and organizations with limited legal resources, the regulatory sandbox offers a valuable opportunity to reduce regulatory uncertainty: instead of interpreting a complex legal framework on their own and risking later sanctions, they can engage directly with those who will assess their compliance, cutting the time and cost of adjustment.
The tool is explicitly provided for by the EU AI Act, which requires member states to establish at least one national AI regulatory sandbox, borrowing a model already tested successfully in other innovative sectors, such as fintech, where regulatory sandboxes have been used for several years to support innovation without lowering protection standards.
La sandbox regolamentare è un ambiente controllato, istituito dalle autorità pubbliche, in cui aziende e sviluppatori possono testare sistemi AI innovativi sotto la supervisione diretta del regolatore, prima o durante la loro immissione sul mercato, beneficiando di un dialogo diretto con le autorità su come interpretare correttamente gli obblighi normativi applicabili.
Il funzionamento tipico prevede che un'azienda venga ammessa a un programma della durata di alcuni mesi, durante il quale sperimenta il proprio sistema AI in condizioni reali ma circoscritte, con la supervisione dell'autorità competente che fornisce indicazioni pratiche su conformità, valutazione del rischio e documentazione richiesta. Al termine del percorso, l'azienda ha maggiore chiarezza su come conformarsi pienamente prima del lancio su larga scala.
Per le aziende, in particolare le startup e le realtà con risorse legali limitate, la sandbox regolamentare rappresenta un'opportunità preziosa per ridurre l'incertezza normativa: invece di interpretare da sole un quadro giuridico complesso e rischiare sanzioni successive, possono confrontarsi direttamente con chi dovrà valutarne la conformità, riducendo tempi e costi di adeguamento.
Lo strumento è previsto esplicitamente dall'EU AI Act, che richiede agli Stati membri di istituire almeno una sandbox regolamentare nazionale dedicata all'AI, mutuando un modello già sperimentato con successo in altri settori innovativi, come quello fintech, dove le sandbox regolamentari sono utilizzate da diversi anni per accompagnare l'innovazione senza abbassare gli standard di tutela.
