The market surveillance authority is the national body designated by each European Union member state to check that AI systems placed on the market or put into service within its territory comply with the requirements of the EU AI Act. It is the AI-domain equivalent of authorities that have long overseen the safety of other regulated products, such as medical devices or industrial machinery.

These authorities have investigative and control powers: they can request access to an AI system's technical documentation, carry out checks and tests, impose corrective measures when a system is non-compliant, and ultimately withdraw from the market or ban the use of systems presenting unacceptable risks. They cooperate with each other at the European level and with the AI Office to ensure a consistent approach, especially for systems distributed across multiple countries simultaneously.
For companies, the competent market surveillance authority is the main counterpart for compliance issues concerning high-risk AI systems: mandatory notifications, clarification requests and any reports of serious incidents related to a system's malfunction are typically addressed to this authority.
The market surveillance model did not originate with the AI Act but is borrowed from the European regulatory framework on product safety, in force for decades to ensure that potentially dangerous goods placed on the single market meet minimum safety standards, now adapted to the specific nature of algorithmic systems.

È l'equivalente, in ambito AI, delle autorità che da tempo vigilano sulla sicurezza di altri prodotti regolamentati, come dispositivi medici o macchinari industriali.
Queste autorità hanno poteri di controllo e indagine: possono richiedere accesso alla documentazione tecnica di un sistema AI, effettuare verifiche e test, imporre misure correttive quando un sistema non è conforme, e in ultima istanza ritirare dal mercato o vietare l'uso di sistemi che presentano rischi inaccettabili. Cooperano tra loro a livello europeo e con l'AI Office per garantire un approccio coerente, specialmente per i sistemi distribuiti in più paesi contemporaneamente.
Per le aziende, l'autorità di vigilanza del mercato competente rappresenta l'interlocutore principale per questioni di conformità relative ai sistemi AI ad alto rischio: è a questa autorità che vanno tipicamente indirizzate le notifiche obbligatorie, le richieste di chiarimento e le eventuali segnalazioni di incidenti gravi legati al malfunzionamento di un sistema.
Il modello di vigilanza del mercato non è nato con l'AI Act, ma è mutuato dal quadro normativo europeo sulla sicurezza dei prodotti, in vigore da decenni per garantire che beni potenzialmente pericolosi immessi nel mercato unico rispettino standard minimi di sicurezza, adattato ora alla natura specifica dei sistemi algoritmici.
