DPA (accordo trattamento dati)
A DPA, or data processing agreement, is a binding contract governing the relationship between a data controller, who decides the purposes and means of using personal data, and a data processor, who processes it on the controller's behalf. It is required by European data protection law whenever an organisation entrusts an external provider with processing personal data. The document sets out what the provider may and may not do with the data, the security measures to adopt, the handling of sub-processors, obligations in case of a breach and the fate of the data at the end of the service.
When a company uses a cloud AI service to which it sends personal data, the provider typically acts as a processor and a DPA becomes necessary. The agreement ensures processing takes place within defined, lawful limits, protecting both the organisation and the individuals concerned.
Il DPA, ovvero accordo sul trattamento dei dati, è un contratto vincolante che regola i rapporti tra un titolare del trattamento, che decide finalità e modalità dell'uso dei dati personali, e un responsabile del trattamento, che li elabora per suo conto. È previsto dalla normativa europea sulla protezione dei dati ogni volta che un'organizzazione affida a un fornitore esterno l'elaborazione di dati personali. Il documento stabilisce cosa il fornitore può e non può fare con i dati, le misure di sicurezza da adottare, la gestione dei subfornitori, gli obblighi in caso di violazione e la sorte dei dati al termine del servizio.
Quando un'azienda utilizza un servizio di intelligenza artificiale in cloud a cui invia dati personali, il fornitore agisce tipicamente come responsabile e un DPA diventa necessario. L'accordo garantisce che il trattamento avvenga entro limiti definiti e conformi alla legge, tutelando sia l'organizzazione sia le persone interessate.
