Diritto alla spiegazione
The right to explanation is the principle that a person subject to an automated decision is entitled to receive understandable information about the logic behind that decision and its consequences. In the European context, this right is linked to data protection rules governing fully automated decisions with significant effects on people, such as a loan refusal or exclusion from a selection process. The individual must be able to understand why a particular decision was made, challenge it and request human intervention.
This right is closely tied to the transparency and interpretability of AI systems: providing an adequate explanation requires the model's operation to be sufficiently understandable. It does not require disclosing proprietary technical details, but clearly communicating the main factors that determined the outcome, enabling the person to assert their rights.
Il diritto alla spiegazione è il principio secondo cui una persona sottoposta a una decisione presa in modo automatizzato ha diritto a ricevere informazioni comprensibili sulla logica alla base di tale decisione e sulle sue conseguenze. Nel contesto europeo, questo diritto è collegato alle norme sulla protezione dei dati che disciplinano le decisioni interamente automatizzate con effetti significativi sulle persone, come il rifiuto di un prestito o l'esclusione da una selezione. L'individuo deve poter capire perché è stata presa una determinata decisione, contestarla e chiedere un intervento umano.
Questo diritto è strettamente legato alla trasparenza e all'interpretabilità dei sistemi di intelligenza artificiale: fornire una spiegazione adeguata richiede che il funzionamento del modello sia sufficientemente comprensibile. Non impone di rivelare dettagli tecnici proprietari, ma di comunicare in modo chiaro i fattori principali che hanno determinato l'esito, permettendo alla persona di far valere i propri diritti.
