For companies developing foundation models, this regulation entails significant investment in documentation, testing and reporting, often disproportionate to what is required of those developing simpler vertical applications. For companies integrating third-party models, it means needing to verify that the provider meets these obligations, since the compliance of the final application also depends on the transparency received upstream.
The debate over how to regulate foundation models, distinctly from applied AI systems, intensified from 2022 and 2023 onward with the rapid spread of large language models, leading the EU AI Act to include a dedicated regime for general-purpose models, while other jurisdictions discuss similar approaches.

Per le aziende che sviluppano modelli fondazionali, questa regolamentazione comporta investimenti significativi in documentazione, testing e reportistica, spesso sproporzionati rispetto a quelli richiesti a chi sviluppa applicazioni verticali più semplici. Per le aziende che invece integrano modelli di terzi, comporta la necessità di verificare che il fornitore rispetti questi obblighi, poiché la conformità dell'applicazione finale dipende anche dalla trasparenza ricevuta a monte.
Il dibattito su come regolamentare i modelli fondazionali, distintamente dai sistemi AI applicativi, si è intensificato a partire dal 2022 e 2023 con la rapida diffusione di modelli linguistici di grandi dimensioni, portando l'EU AI Act a includere un regime dedicato ai modelli per finalità generali, mentre altre giurisdizioni discutono approcci analoghi.
