Harmonized technical standards for AI are detailed technical specifications, developed by European standardization bodies, that translate the general obligations set by the EU AI Act, such as risk management, data quality or system robustness, into concrete, measurable technical requirements. They are not laws in the strict sense, but compliance with them creates a presumption of conformity with the regulation, greatly simplifying the task of demonstrating compliance.
The mechanism works as follows: the regulation defines goals and requirements at a relatively high level of abstraction, while the harmonized technical standards specify how to concretely achieve those goals, for example by indicating precise methodologies for testing a model's accuracy or documenting training data. A provider following these standards can presume compliance, while those choosing alternative approaches must independently demonstrate they achieve the same level of protection.
For companies, relying on these technical standards reduces the interpretive uncertainty inherent in a general regulatory text, providing a clearer operational path to follow, especially for technical teams who must translate legal requirements into concrete design and testing choices.
This mechanism of deferring from law to technical standards, known as the "New Approach", has been used in Europe since the 1980s for industrial product regulation, and has been extended to artificial intelligence precisely to enable regulation capable of adapting quickly to technological progress without having to continually amend the law itself.
