A fundamental rights impact assessment is a specific analysis that certain actors, particularly public bodies and organizations providing essential services, must carry out before using certain high-risk AI systems, to check how the system could affect rights such as non-discrimination, personal data protection, freedom of expression or access to essential services.

Unlike a generic algorithmic impact assessment, this analysis focuses specifically on the fundamental rights recognized by constitutional and supranational charters, and is required by the EU AI Act for deployers operating in particularly sensitive contexts, such as the provision of essential public services, creditworthiness assessment, or life and health insurance. It must describe the process in which the system will be used, the categories of people potentially affected, the specific risks, and the human oversight measures planned.
For organizations required to conduct it, this assessment requires the involvement of legal expertise specialized in human rights and non-discrimination, alongside technical expertise, and must be carried out before the system's actual use, not as a subsequent justification exercise. The result must be made available to the competent market surveillance authority upon request.
The concept fits within the European legal tradition of fundamental rights protection enshrined in the Charter of Fundamental Rights of the European Union, applied for the first time systematically to AI systems through the EU AI Act, recognizing that some impacts of AI cannot be reduced to a simple technical risk calculation.
La valutazione d'impatto sui diritti fondamentali è un'analisi specifica che alcuni soggetti, in particolare enti pubblici e organizzazioni che forniscono servizi essenziali, devono condurre prima di utilizzare determinati sistemi AI ad alto rischio, per verificare in che modo il sistema potrebbe incidere su diritti come la non discriminazione, la protezione dei dati personali, la libertà di espressione o l'accesso a servizi essenziali.
A differenza di una generica valutazione d'impatto algoritmico, questa analisi si concentra specificamente sui diritti fondamentali riconosciuti dalle carte costituzionali e sovranazionali, ed è richiesta dall'EU AI Act per i deployer che operano in contesti particolarmente sensibili, come l'erogazione di servizi pubblici essenziali, la valutazione dell'affidabilità creditizia o l'assicurazione sulla vita e sulla salute. Deve descrivere il processo in cui il sistema sarà usato, le categorie di persone potenzialmente impattate, i rischi specifici e le misure di sorveglianza umana previste.
Per le organizzazioni tenute a condurla, questa valutazione richiede il coinvolgimento di competenze legali specializzate in diritti umani e non discriminazione, oltre a quelle tecniche, e va condotta prima dell'effettivo utilizzo del sistema, non come esercizio successivo di giustificazione. Il risultato deve essere reso disponibile all'autorità di vigilanza del mercato competente su richiesta.
Il concetto si inserisce nella tradizione giuridica europea di tutela dei diritti fondamentali sancita dalla Carta dei diritti fondamentali dell'Unione Europea, applicata per la prima volta in modo sistematico ai sistemi di intelligenza artificiale attraverso l'EU AI Act, riconoscendo che alcuni impatti dell'AI non sono riducibili a un semplice calcolo di rischio tecnico.
